Analysis and Critique of Unifying Decision No. 854 by the Supreme Court Grand General Assembly (Inadmissibility of Retrial under Article 474 Following a Retrial under Article 477 of the Iranian Criminal Procedure Code)

Abstract
This article critically analyzes Unifying Decision No. 854, issued by the Supreme Court Grand General Assembly of Iran on October 30, 2024, concerning the retrial of criminal judgments and the relationship between Articles 474 and 477 of the Iranian Criminal Procedure Code. According to this decision, a request for retrial under Article 474 is deemed inadmissible for judgments rendered based on Article 477. Employing a descriptive-analytical research method and utilizing library sources and relevant judicial rulings, this study examines the decision from multiple perspectives. The article first explicates the content of the ruling and provides a procedural and substantive assessment. It then critiques the ruling from various angles, including the violation of the principle of interpretation in favor of the accused, the lack of logical correlation between reasoning and conclusion, the infringement of fundamental judicial fairness, and its inconsistency with the legislative philosophy behind Articles 474 and 477 of the Iranian Criminal Procedure Code. The analysis demonstrates that the ruling, based on weak reasoning and an illogical connection between argument and conclusion, ultimately undermines the rights of defendants and restricts their access to legal remedies. Consequently, a reconsideration of the unifying decision is necessary, along with an emphasis on fair trial principles, the protection of defendants’ rights, and adherence to the principle of interpretation in favor of the accused. The article concludes with recommendations for revising the ruling to strengthen justice and safeguard the rights of the accused, ensuring that the judiciary operates fairly and equitably.
